Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Bakhtiyarpur P.S. Case No. 147 of 2022 registered for the offence under Sections 147, 148, 149, 447, 448, 341, 323, 307, 354, 379 of the Indian Penal Code.

The prosecution story in short is that 01.04.2022 at about 09.00PM, the father in law of the informant was sitting on his door and in the meantime, all the accused persons came with weapons and assaulted him. Jitenndra Singh assaulted him with Katta on his head and when the informant asked them why they assaulted the father in law, Girish Singh pushed the informant and tore her blause. Learned counsel for the petitioner submits that the petitioner is in custody since 02.02.2023 and the petitioner is innocent and has committed no offence and there is no specific allegation against the petitioner.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the aforesaid facts, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Barh/concerned Court below in connection with Bakhtiyarpur P.S. Case No. 147 of 2022.
