JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-09-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel appearing for the petitioner and Shri Suresh Prasad Singh, learned A.P.P. for the State. The petitioner seeks regular bail in connection with Yadopur P.S. Case No. 101 of 2019 for the offence punishable under Sections 302/34 of the Indian Penal Code, Section 27 of the Arms Act.

The case of the prosecution in brief is that the informant along with her husband and sister-in-law had gone to their field for looking at the water tank on 10.03.2019 at about 10:30 A.M. when the petitioner and seven other accused persons had arrived there, surrounded the husband of the informant and had started

It is further alleged that the petitioner had fired gun shots on the chest below the neck of Amarjeet Singh resulting in his death during the course of treatment. The learned counsel for the petitioner has submitted that the petitioner is innocent, has been falsely implicated in the present case and is having clean antecedent. It is further submitted that the petitioner is not having any complicity in the matter. Per contra, the learned A.P.P. for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the materials available in the case dairy, it is apparent that a prima facie case is definitely made out against the petitioner herein and he is the person against whom there is direct allegation of firing gun shots on the husband of the informant resulting in his subsequent death, hence considering the heinous crime of murder committed by the petitioner, this Court is not inclined to grant bail to the petitioner, hence the present petition stands dismissed.
