The petitioner seeks bail in connection with Mahua P.S. Case No. 157 of 2019 instituted for the offences under Sections 394, 396, 302 and 34 of the Indian Penal Code read with Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 21.09.2020 and charge-sheet has been submitted in the case.
Learned counsel for the petitioner submits that informant in the F.I.R. alleges that his brother Manoj Kumar Singh (deceased) and his associate Birendra Rai (deceased) were Homeguard Jawans and after depositing the money of the

No.30015 of 2021(4) dt.17-01-2022 2/3 Electricity Board in the Bank, both of them came and sat in the vehicle then four accused persons came and tried to snatch the bag and when they protested, they were shot and they died. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the case, the F.I.R. was against unknown and his name transpired in the confessional statement of co-accused and he was not put on T.I. parade. Smt. Renu Kumari, learned A.P.P.
for the State vehemently opposes the prayer for bail of the petitioner and submits that this petitioner is a history-sheeter and has five criminal antecedents as mentioned in paragraph '3' of the bail application, further it is submitted that though his name transpired in the confessional statement but then paragraph '60' of the case diary clearly records that C.C.T.V. footage has captured the petitioner along with three other accused firing and fleeing away with the bag and the petitioner has been identified based on the C.C.T.V. footage of committing the crime. Learned A.P.P. further submits that it seems that this petitioner is a trigger-happy person who did not even bother before taking two innocent lives who were discharging their duties. Considering the submissions of the learned A.P.P.
Patna High Court CR. MISC. No.30015 of 2021(4) dt.17-01-2022 3/3 bail. His prayer for bail is thus rejected.
