In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 307 and 34 of the I.P.C, section 27 of the Arms Act and section 3⁄4 of the Explosive Substance Act.
Allegedly, the petitioner and others opened fire and hurled bomb causing injury to Lal Bihari Rai and Anil Kumar. Submission is that during investigation it has come that Anil Kumar has sustained injury by the firing made by Kapildeo Prasad and Lal Bihari Rai has sustained injury by the firing made by Prabhakar Kumar @ Pappu Yadav. Similarly
Patna High Court Cr.Misc. No.43251 of 2014 (2) dt.20-03-2015 2/2 situated co-accused Bagendra Rai @ Brijendra Rai Yadav has been allowed pre-arrest bail vide Cr. Misc. No. 10160 of 2013 by order dated 11.07.2013 by another Bench of this Court and further co-accused Prabhakar Kumar @ Pappu Yadav has also been allowed anticipatory bail vide Cr. Misc. No. 45082 of 2012 by order dated 08.03.2013 by another Bench of this Court and as such the petitioner also deserves sympathetic consideration. In the facts and circumstances as stated above, the petitioner in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. East Champaran (Motihari) in Madhuban P.S. Case No. 122 of 2011, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
