2. The petitioner apprehends his arrest in connection with Athamalgola P.S. Case No. 389 of 2023 registered for the offences punishable under Sections 341, 323, 307, 379, 34 of the Indian Penal Code.
3. As per the prosecution case, there is allegation of assaulting and looting the informant by 10-15 unknown accused persons including the present petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he was not involved in the offence as alleged. Due to previous enmity he has been falsely implicated in this case. There is general and omnibus allegation against the accused persons. The injuries found on the informant is simple
Patna High Court CR. MISC. No.22055 of 2024(2) dt.22-04-2024 2/2 in nature caused by hard and blunt substance. There is no material against the petitioner and the petitioner has no criminal antecedent.
5. Learned APP opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Athamalgola P.S. Case No. 389 of 2023, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
