JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Hajipur Town P.S. Case No. 600 of 2016 registered under Section 406 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act.

The accusation is that the petitioner handed over a cheque of Rs. 2,00,000/- to the informant on 10.08.2015 but the same was dishonored due to insufficient money and when the informant informed to the petitioner about dishonoring of the cheque then he was assaulted and abused and petitioner refused to return the money.

Patna High Court Cr.Misc. No.2507 of 2017 (2) dt.03-03-2017 2/2 It is submitted on behalf of the petitioner that it is not detailed in the F.I.R that for what purpose this petitioner has taken loan of Rs. 2,00,000/- for which the cheque was issued to the informant.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner namely Md. Khurshid Alam, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within six weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
