This is an application for grant of anticipatory bail in connection with Excise Case No.887 of 2018 disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Prosecution story is of recovery of 99 liters of foreign liquor from the Rice Mill and the petitioner is made accused by the owner of the rice mill.

Submission of the learned counsel for the petitioner is that as a matter of fact, Rice Mill is run by his brother who has taken loan, now it is closed and petitioner is an L.I.C. agent and he has been made accused only because the rice mill is in the

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-II, Jehanabad, in connection with Excise Case No.887 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
