====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-04-2019 Heard the learned counsel for the petitioner and the State.

The petitioner is aggrieved by the decision of the committee which has rejected the application of his father for his voluntary retirement on the ground that the application for voluntary retirement was submitted only on the date when the father of the petitioner intended to retire. One of the conditions for the consideration of the nominated person for being appointed in the place of his relative as a Chaukidar is that such application for voluntary retirement has to be given at least a month before the optional date of retirement.

Patna High Court CWJC No.6974 of 2019(2) dt.26-04-2019 2/2 Since the application was filed on the chosen date of retirement, no consideration has been made by the committee over the candidature of the petitioner, who is the son of the employee.

This Court has not been persuaded to interfere with the decision of the committee.

The writ petition is dismissed accordingly.
