The petitioner is accused in connection with Chausa P.S. Case No. 61 of 2014, registered under Sections 399 & 402 of the Indian Penal Code and Section 25(1-a),(1-b)a,26 and 35 of the Arms Act.
Learned counsel for the petitioner submits that it would appear from the F.I.R. itself that the petitioner was not apprehended by the Police rather the name of the petitioner has been disclosed by co-accused Bulo Yadav, who is said to be apprehended by the Police with two rifles, except the confessional statement of the co-accused, there is nothing against the petitioner to show his involvement in the present. Learned counsel for the petitioner Sri Shailendra Kumar Singh submits
Patna High Court Cr.Misc. No.27883 of 2016 (2) dt.14-07-2016 2/2 that petitioner is accused in four other cases, as detailed in para03 of the petition, but he is on bail in all the cases and in the present case, he is in custody since 04.02.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Uda-Kishunganj, Madhepura in connection with Chausa P.S. Case No. 61 of 2014. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
