The petitioner seeks modification of the order dated 30.09.2016 passed in Cr. Misc. No.37964 of 2016 by which he has been granted provisional anticipatory bail.
The petitioner could not surrender within time and furnish bail bond but now the petitioner undertakes to deposit the entire amount of Rs.30,000/- within a week.
Accordingly, in view of the statements made in the application, the order dated 30.09.2016 passed in Cr. Misc. No.37964 of 2016 is modified to the extent that the period of surrender before the Chief Judicial Magistrate, Siwan in connection with Jamo Bazar P.S. Case No.51 of 2015 is extended till 15.02.2017.
If the petitioner deposits the entire amount of
Patna High Court Cr.Misc. No.2945 of 2017 (2) dt.25-01-2017 2/2 Rs.30,000/- within the aforesaid period then he would be released on anticipatory bail.
However, if the petitioner fails to deposit the entire amount on or before the aforesaid date then his bail bound would not be accepted by the court below.
This application stands disposed of.
