====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 28-09-2018 Heard learned counsel for the petitioners, the informant and the learned A.P.P. for the State.

The petitioners seek bail in Mashrak P.S. Case No. 206/2018, instituted for the offences under Sections 363, 366A and 34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioners have clean antecedent. They are in custody since 21.07.2018.

In the written report, it is alleged that minor daughter of informant had gone to attend call of nature but she did not return. Thereafter, informant learnt that his daughter has been kidnapped by these petitioners.

No.55845 of 2018 (2) dt.28-09-2018 2/2 Learned counsel for petitioners has submitted that occurrence is alleged to have taken place on 24.04.2018 and F.I.R. has been lodged on 21.06.2018, after delay of about two months. It is mentioned in para 8 of bail petition that informant's daughter Kabita Kumari and co-accused Rakesh Rai have performed marriage and they are residing together as husband and wife. These petitioners are said to be brothers of aforesaid Rakesh Rai. Considering the aforesaid fact and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 6th A.C.J.M., Saran at Chapra in connection with Mashrak P.S. Case No. 206/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners.
