The petitioner apprehends his arrest in connection with Bagaha (Pathkhauli) P.S. Case No.273 of 2014 registered under Sections 324, 308, 419 and 420/34 of the Indian Penal Code. The accusation is that the informant, who is the Medical officer, Primary Health Centre, Bagaha, West Champaran, inspected the clinic situated at the house of the petitioner where one lady was found admitted to whom saline was being provided and on query she disclosed that the operation of her uterus has been made on 18.06.2014 and she and her attendant disclosed that the said clinic is being run by Dr. Rais Ansari and she is being

Patna High Court Cr.Misc. No.41873 of 2014 (2) dt.16-04-2015 2/2 treated by two persons. The lady patient was referred to SubDivisional Hospital, Bagha, for proper treatment. In the Operation Theatre of the said clinic medicine kept in an almirah was found, which was not up to the mark. Dr. Rais Ansari was found absconding from the clinic. It appeared to the informant that in the said clinic illegal work is being done by which any person may loss his life.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. itself that the petitioner has no concern with the said clinic rather the same was being run by Dr. Rais Ansari in the house of the petitioner. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within four weeks, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Bagaha, District-West Champaran, in connection with Bagaha (Pathkhauli) P.S. Case No.273 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
