Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366A of the Indian Penal Code.

The accusation is of kidnapping the minor niece of the informant.

It is submitted by learned counsel for the petitioner that the victim in her 164 Cr.P.C statement got her age recorded as 19 years whereas Court assessed as 18 years wherein she has stated that she of her own married with petitioner.

Considering the 164 Cr.P.C statement of the victim, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on

Patna High Court Cr.Misc. No.36229 of 2015 (2) dt.08-09-2015 2/2 furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Hajipur in connection with Sarai P.S. Case No. 20 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
