Mr. Anuj Kumar Srivastava, APP ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 06-10-2018 I have heard learned counsel for the petitioners and the State.

The petitioners seek bail in a case registered for offences punishable under sections 272 and 273 of the Indian Penal Code and under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 40 litres 400 Ml. of country-made liquor was recovered from a bag which was thrown by the petitioners and fled away after seeing the police party but after chase they have been apprehended. It is contended that nothing has been recovered from the conscious possession of the petitioners rather they have been falsely implicated in the present case. Petitioners claim that they are

Patna High Court Cr.Misc. No.58854 of 2018(2) dt.06-10-2018 2/2 having clean antecedents and are in custody since 11.08.2018. Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on their furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Gopalganj, in connection with Mirganj P.S. Case No. 223 of 2018.

If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
