The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 201, 376 and 34 of the Indian Penal Code and 27 of the Arms Act. As per F.I.R., the informant suspects that co-accused, namely, Mukesh Kumar, who was in love affairs with the deceased girl had committed murder of his sister after committing rape.

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. Petitioner is not named in the F.I.R. and the name of the petitioner transpired during the course of investigation merely on the basis of suspicion. There is no material available to connect the

No.20306 of 2023(2) dt.24-06-2023 2/2 petitioner with the alleged murder while the evidence collected in course of investigation establish love relationship between co-accused and deceased girl and later on she committed suicide. Similarly situated co-accused person has already been granted bail by order order dated 04.04.2023 passed in Cr. Misc. No. 44461 of 2022. The petitioner has no criminal antecedent as stated at para 3 of the bail petition.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Tiyar P.S. Case No. 06 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) sanjeev/- U T
