The petitioners seek anticipatory bail in a case instituted for the offence under Sections 147, 148, 149, 323, 325, 307 and 302 of the Indian Penal Code.

It has been submitted that there is general and omnibus allegation against the petitioners in the written report. From the written report, it appears that the informant was going to Karia Chowk to bring mustard oil. He saw the petitioners along with other accused persons total 18 in numbers, were pelting brick pieces near Kirana shop. The informant tried to

Patna High Court Cr.Misc. No.4397 of 2017 (2) dt.13-02-2017 2/2 stop them, then they started abusing him. The informant sustained injury and fell down. As such there is no any allegation of specific overt act against the petitioners.

Considering the facts and circumstances of the case, let the petitioners above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Kamtaul P.S. Case No. 43 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
