The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 379, 380, 504 of the Indian Penal Code.
The prosecution case is that in the background of dispute with regard to partition, the accused persons were cutting bamboo and kadam tree, which were protested by the daughters of the informant Rani Kumari and Babli Kumari, whereupon the accused persons assaulted the informant and her daughters. The injured Rani Kumari received grievous injury as she was ultimately brought to P.M.C.H. but a injury report is not on record. Neither the First Information Report nor the impugned order reflects the
Patna High Court Cr.Misc. No.35321 of 2015 (2) dt.03-09-2015 nature of injury received by Rani Kumari and similarly situated co-accused Sita Devi and Most. Sulena Devi have been granted bail vide Cr. Misc. No. 32329 of 2014. Considering the fact that the accusation has been levelled in the background of partition dispute and the petitioner is a lady, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri B.K. Singh, Judicial Magistrate, Ist Class, Saharsa in connection with Sonbarsa Raj (Kashnagar O.P.) P.S. Case No. 99 of 2012, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
