Petitioner has earlier move this Court twice for grant of bail in Cr. Misc. Nos. 55275 of 2018 and 45729 of 2019, which were rejected vide orders dated 02.11.2018 and 21.08.2019 respectively.

Learned counsel for the petitioners submits that the petitioner has been falsely implicated in this case. It is further submitted that out of 11 prosecution witnesses, 10 have already been examined. Petitioner has no criminal antecedent and is languishing in judicial custody since 16.05.2018. Vide order dated 16.06.2020 a report was called for from the court below regarding the stage of the trial, which has

Patna High Court CR. MISC. No.19483 of 2020(4) dt.25-08-2020 2/2 been received. Perusal whereof shows that out of 11 prosecution witnesses only Investigating Officer is left to be examined. Having considered the above facts and circumstances of the case specially the fact that petitioner's prayer for bail has been earlier rejected twice and there is no fresh ground urged on behalf of the petitioner, the prayer for bail is rejected. However, the trial Court is directed to expedite the trial of the case and conclude it within a period of three months.
