JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-03-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 419 and 420 of the Indian Penal Code.

As per the prosecution case, one Gautam Kumar, a candidate appearing in a competitive examination was found using Bluetooth and was talking to someone. On the basis of the confessional statement of said Gautam Kumar, the petitioner has been implicated in the present Hawai Adda P.S. Case No. 199 of 2013.

Learned counsel for the petitioner submits that there is no specific allegation against this petitioner, who also got no criminal antecedent.

No.43148 of 2014 (2) dt.20-03-2015 2/2 In view of the above, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna, in connection with Hawai Adda P.S. Case No. 199 of 2013 (G.R. No. 7183 of 2013), subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
