JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.

Petitioner happens to be brother in law of the deceased. The first information report reveals that marriage of deceased had taken place five years ago but in course of investigation, witnesses stated that marriage of deceased had taken place ten years ago. Moreover, in written report of the informant, general and omnibus allegation has been levelled against the petitioner.

Learned counsel for the petitioner points out that

Patna High Court Cr.Misc. No.30739 of 2016 (2) dt.09-08-2016 2/2 having similar allegation, co-accused, Anil Paswan and some others have already been granted privilege of anticipatory bail. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Amit Kumar Tiwari, Judicial Magistrate 1st Class, Muzaffarpur in connection with Karja P.S.
