JUSTICE ARUN KUMAR ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 272, 273, 308 of the Indian Penal Code and Section 47 Excise Act.

Allegation in brief is that the plastic bag containing 109 pouch of country made liquor was recovered from the S.T.D. shop of the petitioner.

However, the police after investigation did not find the involvement of the petitioner and not sent up for trial but the cognizance was taken against him also by the court below and this petitioner has no criminal antecedent.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of

No.5725 of 2017 (3) dt.08-02-2017 2/2 receipt of this order to the concerned court, let the petitioner, namely, Sanjay Singh be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. (West), Muzaffarpur in connection with Saraiya P.S. Case No.229 of 2009, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arun Kumar, J) N.H./- U T
