JUSTICE SUDHIR SINGH ORAL ORDER 27-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 353 and 387of the Indian Penal Code. Prosecution case is that informant, who is a judicial officer, was telephoned by an unknown person to release his nephew and also asked him to deposit Rs. 25 lacs., otherwise he would be killed.
It has been submitted on behalf of the petitioner that he is in custody since 10.6.2016. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Petitioner is in armed force. He had come on his vacation. The sister of the petitioner was abducted for the purpose of marriage in which a case was also instituted. In retaliation to the said case petitioner has falsely been implicated in the present case. None of the mobile by which ransom was demanded belongs to petitioner. On behalf of the State, it is submitted that petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.32542 of 2016 (4) dt.27-09-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Town P.S. Case no. 361 of 2016.
