JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 30-04-2019 This application under Articles 226 and 227 of the Constitution of India has been filed by the petitioner for quashing the order dated 16.01.2018 passed in Misc. Case No.01 of 2017 by the learned Additional Chief Judicial Magistrate-VII, Saran at Chapra by which he has dismissed the application filed under Section 340 of the Code of Criminal Procedure in Doriganj P.S. Case No.113 of 2014 and also for quashing the order dated 25.10.2018 passed in Cr. Appeal No.11

Patna High Court CR. WJC No.721 of 2019(2) dt.30-04-2019 2/2 of 2018 by the learned Additional Sessions Judge-1, Saran at Chapra whereby he has dismissed the appeal preferred by the petitioner against the aforesaid order dated 16.01.2018 passed in Misc. Case No.01 of 2017.

After some arguments, Mr. Avanindra Kumar Jha, learned counsel for the petitioner seeks leave to withdraw the present application.

Leave is granted.
