JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 324, 325, 326, 379, 307 and 504 of the Indian Penal Code. The prosecution case is that the informant and his brother were erecting animal shed over the land of Ram Janaki Math with the permission of Mahanth when accused persons came variously armed and made assault to the informant and thereafter when the brother and co-villagers of the informant came to rescue, they were also assaulted. It is alleged against the petitioner that he assaulted with axe on the head and mouth of Yogi Yadav. It is submitted by learned counsel for the petitioner that incise injury on the head has been found to be simple but one tooth of Yogi Yadav got uprooted and the same has been treated to be

Patna High Court Cr.Misc. No.35059 of 2015 (2) dt.20-08-2015 2/2 grievous. There is counter version of the occurrence also. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Bisfi P.S. Case No. 47 of 2014 pending in the court of learned JM, 1st Class, Madhubani. Accordingly, the application is disposed of.
