JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, the name of petitioner came in this case. The learned Additional Sessions Judge-III, Jamui has referred four paragraphs of the case diary in his impugned order to show the evidence collected by the investigating officer against the petitioner but from perusal of paragraphs no. 76, 82 and 88 of the case diary, I find that aforesaid paragraphs relate to information given by the spy of the police and so far as Para-108 of the case diary is concerned, the same is so-called confessional

No doubt, petitioner carries criminal antecedent of two cases but taking note of material available against the petitioner in the present case as well as his period of detention in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Chandrmandi P.S.
