The petitioner seeks bail in Khagaria P.S. Case No. 387/2018, instituted for the offences under Sections 363 and 365 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner is in custody since 15.06.2018. It is alleged in the written report that petitioner has kidnapped the daughter of informant. The victim has given her statement under Section 164 Cr.P.C., which is enclosed as Annexure-3, wherein she has disclosed her age to be 18 years. The Court below has also assessed the age of victim to be 18 years. In her statement she has not levelled any allegation of specific overt act of committing illegal act with her against this petitioner. It is further submitted
Patna High Court Cr.Misc. No.55776 of 2018 (2) dt.08-10-2018 2/2 that both girl and petitioner are having love affairs, which is apparent from Annexure- 2 series.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria in connection with Khagaria P.S. Case No. 387/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
