The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 201, 120B and 34 of the Indian Penal Code.

As per the prosecution case, the informant was informed by his wife that the informant's father had gone with the petitioner herein and did not return. Subsequently the next day the dead body of the informant's father was found in front of the house of the co-accused Arjun Oraon.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case on the basis of unsubstantiated suspicion raised against him. Even

Patna High Court CR. MISC. No.29363 of 2021(3) dt.20-12-2021 2/2 accepting the allegation levelled in the FIR, the case against the petitioner at best is of last seen. There is no eye witness to the alleged occurrence nor has anything transpired against the petitioner in course of investigation to implicate him in the alleged crime. He is in custody since 10.1.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for over 11 months and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with K. Hat (Sahayak) P.S. Case no. 31 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnia.
