JUSTICE SANJAY PRIYA ORAL ORDER 21-02-2017 Heard learned counsel for the petitioner and the State.

The petitioner apprehends his arrest in Rasulpur P.S. Case No. 66 of 2016 instituted for the offence under Sections 302 and 201/34 of the Indian Penal Code.

The petitioner is the husband of the deceased. It is alleged that petitioner along with co-accused Girija Kunwar has killed the daughter of the informant with intention to perform another marriage and has also cremated the dead body without informing the parents of the deceased.

Learned A.P.P. has submitted that witnesses in paras-3,6, 7 and 8 of the case diary have stated that petitioner along with co-accused has committed murder of the deceased and

Patna High Court Cr.Misc. No.3110 of 2017 (3) dt.21-02-2017 2/2 disposed of the dead body.

In such circumstances, petitioner being the husband of deceased and keeping in view serious allegation against him, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this anticipatory bail petition is hereby rejected.

The petitioner is directed to surrender before the court below within four weeks from today and seeks regular bail which shall be disposed of by the court below in accordance with law without being prejudiced by this order.
