JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-06-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Dharahra (Hemjapur O.P.) P.S. Case No. 250 of 2019, G.R. No. 2997 of 2019 for the offenses under Section 302 of the Indian Penal Code.
Learned counsel for the petitioner would submit that petitioner is not named in the FIR. His name surfaced on the basis of confessional statement of co-accused Dumka. The petitioner has no criminal antecedent. The petitioner is in custody since 29.12.2019.
Considering the fact that the petitioner has no criminal antecedent, he was not named in the FIR, his name

No.17664 of 2020(2) dt.03-06-2020 2/2 surfaced on the confessional statement of the co-accused and there is no eye witness to the occurrence, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in connection with Dharahra (Hemjapur O.P.) P.S. Case No. 250 of 2019, G.R. No, 2997 of 2019 subject to the condition that on release the petitioner shall render his services as volunteer to combat the pandemic of Covid-19 for a period of two months.
