====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-04-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Alauli P.S. Case No. 443/2019 registered for the offence punishable under Section 392 of the Indian Penal Code.

This is second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier the bail application of the petitioner was rejected by this Court vide order dated 20.12.2021 passed in Cr. Misc. 31090 of 2021 with liberty to renew his prayer for grant of regular bail after three months. The allegation as per the First Information Report is that four miscreants riding on two Motorcycles intercepted the

Patna High Court CR. MISC. No.19837 of 2022(2) dt.20-04-2022 2/3 informant and snatched a sum of Rs.15,000/-, ATM Card, Aadhar Card, Mobile phone etc. on gun point.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case. He further submits that this is second attempt for bail on behalf of the petitioner inasmuch as earlier the bail application of the petitioner was rejected by this Court giving him liberty to renew his prayer for bail after three months. He next submits that the petitioner is in custody since 2.5.2020 and the case is triable by the Magistrate.

Regards being had to the submission made by the parties and taking into consideration the period of custody and this is second attempt for bail on behalf of the petitioner, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Alauli P.S. Case No. 443/2019 subject to the condition that the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates,
