JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-08-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Section 25 (1-b) a/26/35 of the Arms Act. Petitioners and other accused persons were caught by the police, while they had allegedly assembled to make preparation for committing crime. According to the written report of the informant, one iron Khanti, one hammer, khanti, mobile etc. were recovered from the possession of the petitioner no.1 but seizure list goes to show that only mobile sets have been recovered from the possession of the petitioner no.1. So far as petitioner no.2
Patna High Court Cr.Misc. No.30735 of 2016 (2) dt.08-08-2016 2/2 is concerned, it is alleged that mobile set has been recovered from his conscious possession. The petitioners do not have any criminal antecedent and having more or less similar allegation, co-accused Rustam Dom has already been granted privilege of bail by a coordinate Bench of this court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 05 of 2016.
