The petitioner is apprehending his arrest in connection with Sol. (POCSO) Case No.236 of 2018 arising out of Gandhi Maidan P.S.Case no.611 of 2018 registered for offences punishable under Sections 354(A), 354(D), 323, 341, 342/34 of the Indian Penal Code and Section 12 of POCSO Act. Allegation against the petitioner is of kidnapping the minor daughter of the informant and also tried to misbehave with her and further assaulted her causing some violence on her face.

Submission of the learned counsel for the petitioner is that thee is delay in lodging the FIR and the petitioner has falsely been implicated in this cse.

No.20250 of 2019(3) dt.07-05-2019 2/2 Having heard both sides and as the girl is minor, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below, which will be considered on the basis of materials available on the record. With the aforesaid direction, this application is dismissed.
