This application for grant of anticipatory bail arises out of Suryapura P.S. Case No. 20/2015, disclosing offences under Sections 457 and 380 of the Indian Penal Code. This application, so far as petitioner no.2, Upendra Singh, is concerned, has become infructuous because he has been arrested during the pendency of this application. Considering the nature of accusation and the materials collected in course of investigation, I am not inclined to grant petitioner no.1 the privilege of anticipatory bail. Petitioner no.1 is directed to surrender before the court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for anticipatory bail.
