JUSTICE BIRENDRA KUMAR ORAL ORDER 18-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State-Opposite Party. The petitioner had not removed the defects in Cr. Misc. No.52057 of 2016 in spite of peremptory order dated 07.12.2016. Hence, the aforesaid application was dismissed. The present application for restoration of the aforesaid application on the ground that defects have already been removed.

Considering the aforesaid facts, the dismissal is set aside and the Cr. Misc. No.52057 is restored to its original file with condition that petitioner shall deposit Rs.200/- in the Patna High Court Victim Compensation Fund.
