The petitioner seeks bail in Katra P.S. Case No. 45/2002, instituted for the offences under Sections 147, 148, 447, 341, 324 and 307 of the Indian Penal Code read with Section 27 of Arms Act.

Learned counsel for the petitioner has submitted petitioner was arrested on 18.12.2017 and since then he is in custody. There is specific allegation against Md. Jaan of causing firearm injury to Md. Rizwan. Petitioner and other accused had also made firing on informant and others, which did not hit anybody. It is further submitted that trial has also proceeded. Witnesses have not levelled any specific allegation against this

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Addl. Sessions Judge, Muzaffarpur in connection with Katra P.S. Case No. 45/2002, S.Tr. No. 699/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
