The petitioner is apprehending his arrest in connection with Sakra P.S.Case nO.448 of 2018 dated 13.10.2018 (G.R.No.6454 of 2018) , registered for offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner as per FIR is that the petitioner and several other accused persons came variously arms and there is allegation of assault by lathi and danda. Submission of the learned counsel for the petitioner is that there is no specific allegation against the petitioner and one of co-accused having similar allegation has been granted privilege of anticipatory bail by a Co-ordinate Bench of this court, vide order dated 1.4.2019 passed in Cr. Misc. No.19435

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge 13 cum ACJMIV, Muzaffarpur in connection with Sakra P.S.Case No.448 of 2018 dated 13.10.2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid direction, this application is allowed.
