1. The present petition has been filed for modifying the condition imposed upon the petitioners vide order dated 29.04.2023, passed in Cr. Misc. No.73449 of 2022 while granting the privilege of anticipatory bail to the petitioners and now it is prayed that the condition imposed upon the petitioners with regard to marking their attendance before the Officer-inCharge of the concerned police station on each Monday of the
Patna High Court CR. MISC. No.22507 of 2025(2) dt.11-04-2025 2/3 week at 10:30 a.m., be waived and instead the petitioners be permitted to mark their attendance before the Ld. Trial Court in the on going case.
2. The learned counsel for the petitioners has submitted that right from the time the petitioners were enlarged on anticipatory bail, they have been regularly marking their attendance before the Officer-in-Charge of the concerned police station on each Monday of the week at 10:30 a.m. and there has been no default till date, however since all the five petitioners belong to the same family, they are put to inconvenience inasmuch as the whole day is spent at the police station, thus a sympathetic view be taken and the aforesaid condition be relaxed, accordingly.
3. Having regard to the facts and circumstances of the case and considering the averment made in the present petition as also taking into account the fact that the petitioners have been marking their attendance before the Officer-in-Charge of the concerned police station on each Monday of the week without any default till date, I deem it fit and proper to modify the said condition imposed upon the petitioners vide order dated 29.04.2023 and direct that the petitioners shall appear on each and every date so fixed before the Ld. Trial Court in the case
Patna High Court CR. MISC. No.22507 of 2025(2) dt.11-04-2025 3/3 appertaining to Manpur P.S. Case No.98 of 2022 (G.R. No.2541 of 2022), pending before the concerned Court at West Champaran at Bettiah and in case of any default in appearing before the Ld. Trial Court on the date so fixed, the present privilege of anticipatory bail granted to the petitioners shall stand cancelled automatically and they shall be liable to be taken in custody forthwith.
4. The present petition stands disposed off with the aforesaid modification in the order dated 29.04.2023, passed in Cr. Misc. No.73449 of 2022.
