ANJANA MISHRA ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Sarai P.S. Case No. 66/14 registered for the offences punishable under Sections 302, 201 and 120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is the elder brother of the husband of the deceased Meeta Devi and has been living in Delhi and is employed as security guard in a Beauty Parlour. Learned counsel for the petitioner further submits that there is allegation that petitioner's wife had illicit relationship with the husband of the deceased but there is no iota of evidence to show that there was any illicit relationship between them. It has also been submitted that the petitioner has been living in Delhi whereas the deceased and her husband was staying in Kanpur

Patna High Court Cr.Misc. No.43327 of 2014 (4) dt.16-04-2015 P2/2 where she was also treated in the month of February for her ailment at the Government Hospital.

Considering the nature of allegations and also the fact that there does not appear any cogent evidence to connect the petitioner save and except the allegation made by the informant which stands controverted by the fact that the petitioner and his wife were living away from the deceased and her husband, let the petitioner, in the event of his arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, Vaishali at Hajipur in connection with Sarai P.S. Case No. 66/2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
