For the Opposite Party/s : Mr. Uma Shankar Pd. Singh CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-08-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the complainant is languishing in custody since 1.6.2016 in a complaint case in which process has been directed to be issued after cognizance being taken under Section 498A of the Indian Penal Code. The basic accusation is of torture.

It is submitted by the learned counsel for the petitioner that the petitioner was granted anticipatory bail vide order dated 7.8.2008 passed in Cr. Misc. No. 6995 of 2008 on the undertaking that the petitioner is ready to keep the complainant as wife with full dignity and honour but thereafter he failed to comply the undertaking. Consequently, in view of the observations made in

Patna High Court Cr.Misc. No.36079 of 2016 (2) dt.23-08-2016 2/2 Cr. Misc. No. 6995 of 2008 the bail bonds of the petitioner was cancelled and the petitioner thereafter absconded. Considering the nature of accusation and the period in custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Araria in connection with Complaint Case No. 1110C of 2007.

The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on two consecutive occasions. (Dinesh Kumar Singh, J) Anil/- U T
