JUSTICE SANJAY PRIYA ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in Kumarkhand P.S. Case No.62 of 2016 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.

From the written report it appears that on the order of this petitioner one Anil Yadav fired, but nobody sustained injury. Thereafter, Upendra Yadav assaulted with Farsa causing injury on the shoulder of the informant. It is further alleged that Afroz Alam also assaulted with iron rod.

Considering the fact that the petitioner is merely an order-giver, his prayer for anticipatory bail is allowed. In the event

Patna High Court Cr.Misc. No.3584 of 2017 (2) dt.09-02-2017 of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Kumarkhand P.S. Case No.62 of 2016, he shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Madhepura, subject to the conditions as laid down under Section 438(2) Cr.P.C.
