The petitioner seeks bail in anticipation of his arrest in connection with Tarapur P.S. Case No. 81 of 2017 dated 08.05.2017 instituted for the offence under Section 379 of the Indian Penal Code.

The name of the petitioner has transpired in the confession of one Prakash Yadav from whose possession the stolen motorcycle was recovered.

Learned counsel appearing for the petitioner has submitted that two other cases in which he has been made accused are also based on confession only and there has not been any recovery from him. In one of the cases referred to above, the petitioner has been granted anticipatory bail by a bench of this Court.

No.57757 of 2018(2) dt.11-12-2018 2/2 Considering the aforesaid facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IVth Munger in connection with Tarapur P.S. Case No. 81 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
