ANJANA MISHRA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 03.02.2018 in connection with Kahalgaon (Rasalpur) P.S. Case No. 557/2017 registered for the offences punishable under Sections 147/148/149/ 447/342/302 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the entire allegation is false and frivolous and the petitioner has been named in the First Information Report, but no specific act has been attributed to the present petitioner. It is further submitted that at best, the petitioner can be treated to be a member of the crowd and there is no evidence that he is involved in the present case. It is also submitted that similarly situated co-accused Pramod Mandal has since been granted bail by this Court vide order dated 30.07.2018 passed in Cr. Misc. No. 28486 of 2018 (Annexure-2).

In view of the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Addl. Sessions Judge, Bhagalpur, in connection with Kahalgaon (Rasalpur) P.S. Case No. 557/2017.
