The petitioner is apprehending his arrest in connection with G.O. Case No.1334 of 2019 arising out of Baheri P.S. Case No.302 of 2019 registered for the offence under Section 30(a), of Bihar Prohibition and Excise Act, 2016.

As per allegation in the FIR, there was recovery of 198 liters of illicit liquor from Bharat Tent House. Learned counsel for the petitioner submits that the petitioner has committed no offence and he has falsely been implicated in this case. He further submits that the petitioner has no criminal antecedent. He further submits that similarly situated co-accused, namely, Sushil Yadav @ Tata has already

Patna High Court CR. MISC. No.17610 of 2020(2) dt.03-11-2021 2/2 been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr.Misc.No.23141 of 2020 vide order dated 30.09.2020.

However, learned APP for the State vehementally opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, in the event of his arrest or surrender before the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge (Excise Act), Darbhanga in connection with G.O. Case No.1334 of 2019 arising out of Baheri P.S. Case No.302 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
