JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 147 and 153 of the Railway Act.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that no specific allegation is alleged against the petitioner and he has been arrested only on the basis of suspicion as he was found at the place of occurrence. Petitioner has falsely been made accused in the present case as there was dispute between the vendors and the police officials.
Heard learned A.P.P. also. He has opposed the prayer for anticipatory bail.
Having heard both sides and in view of the facts
Patna High Court Cr.Misc. No.4700 of 2017 (2) dt.13-02-2017 2/2 aforesaid, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected.
However, petitioner is directed to surrender in the court below, i.e., learned Railway A.C.J.M., Bhojpur at Ara in connection with Buxar R.P.F. Case no. 1305 of 2016 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court.
