2. The petitioner seeks regular bail in connection with Barauni (F.C.I.) P.S. Case No. 64 of 2022, lodged on 03.02.2022, under Sections 363 and 365 of the I.P.C. Subsequently, offence under Sections 302 and 201 of the I.P.C. was added.

3. Learned counsel for the petitioner submits that the bail application of the petitioner was earlier rejected vide order dated 24.02.2023 passed in Cr. Misc. No. 58663 of 2022 with a direction to the trial Court to expedite the trial and conclude the same within 9 months.

4. Learned counsel for the State opposes the prayer for bail and submits that a report about the status of criminal

Patna High Court CR. MISC. No.29815 of 2024(5) dt.14-08-2024 2/2 trial was called for.

5. Upon perusal of the report, it transpires to this Court that the entire prosecution witnesses have been examined, the statement under Section 313 of the Cr.P.C. took place and evidence of defence witness is going on.

6. As such, this Court is of the firm view that delay is on the part of the petitioner himself. Therefore, this Court is not inclined to grant bail to the petitioner. Hence, this bail application stands dismissed.
