JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 04-04-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Complaint Case No. 1997 of 2015/ T.R. No. 1032 of 2016 for the offence punishable under section 498 (A) of the I.P.C.

Munita Devi, the complainant, was married to the petitioner on 31.05.2013 and after marriage the petitioner and others started demanding Hero Honda Motorcycle and due to non fulfillment she was being assaulted and tortured and ultimately the complainant was ousted from the in-laws house after snatching all

Patna High Court Cr.Misc. No.2702 of 2017 (5) dt.04-04-2017 2/2 her belongings and ornaments on 16.06.2015 and since then she is living in her paternal house.

Submission is of false implication and that the petitioner is always ready to keep the complainant as his wife with honour and dignity but she is not ready to live with him, the petitioner never demanded anything and all the allegations are false and concocted and as such the petitioner deserves sympathetic consideration.

The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner.

In the facts and circumstances as stated above, considering that the petitioner is husband and there is specific allegation against him and as such I am not inclined to grant privilege of pre-arrest bail to him and accordingly his such prayer stands rejected in connection with the aforementioned case pending in the court of Sub.Judge-IX-Cum-A.C.J.M.
