JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Excise Act. The learned counsel for the petitioner submits that the petitioner is in custody since 19.01.2022, charge-sheet has been submitted in this case and has antecedent of one case. Allegation is of recovery of 50 litre of liquor from a jute bag from a motorcycle.

The learned counsel for the petitioner submits that petitioner had parked his motorcycle and had gone to a shop and it appears that in his absence, someone had kept the jute bag. Thus, the petitioner came to be implicated.

Learned A.P.P. opposes the bail application.

No.19967 of 2022(2) dt.29-04-2022 2/2 Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Rajauli P. S. Case No.17 of 2022.

The application stands allowed.
