The petitioners are apprehending their arrest in a case registered for the offences punishable under sections 341, 504,384,467,468, 120B of the Indian Penal Code. The prosecution case is that the husband of the informant took a double storey building on rent from co-accused Kamlawati Devi to run a Women Welfare Centre since 2006 but in November 2011 he fell seriously ill and went to Bombay for treatment but he died during treatment. Thereafter the informant returned and approached the accused persons to start the centre and they demanded Rs. 20.000/- and consequently Rs. 15000/-

Patna High Court Cr.Misc. No.33696 of 2015 (2) dt.13-08-2015 2/2 was transferred in the account of petitioner no.1 and thereafter a cheque of Rs. 5000/-was issued in the name of petitioner no.2.But thereafter the accused took the informant, her sister and daughter in a room and took signature of the informant on blank paper. It is submitted by learned counsel for the petitioners that agreement was between Kamlawati Devi mother of petitioner no.2 and the husband of the informant and the amount which was transferred in the account was the arrears of rent. It is further submitted that Kamlawati Devi has been granted anticipatory bail vide Cri. Misc. No. 952 of 2015.

Considering the aforesaid facts, the above named petitioners in the event of their arrest or surrender before the court below within a period of 12 weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M, Gopalglanj in Gopalganj (Town) P.S. Case No. 374 of 2013, subject to the conditions laid down under section 438(2) Cr.P.C.
