The petitioner is languishing in custody in connection with Bettiah Town P.S. Case No. 202 of 2016 for the offences instituted under Sections 363, 365 and 381 of the Indian Penal Code.
There is allegation against the maid servant of the informant namely Shabnam for abducting the minor son of the informant. It is also alleged against her that she took away the mobile of the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.05.2016. The charge sheet has been submitted in the present case. The petitioner has got no
Patna High Court Cr.Misc. No.30627 of 2016 (3) dt.08-09-2016 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not name in the First Information Report. His name has come in course of investigation. The main allegation has been made against co-accused namely Shabnam. From the confession of the petitioner, it appears that he had come to Bettiah to return the child to his parents, where he was arrested by the police. The confession of the petitioner is in paragraph-50 of the case diary. On behalf of the state it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Bettiah Town P.S. Case No. 202 of 2016.
