JUSTICE SUDHIR SINGH ORAL ORDER 20-10-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted for the offences under Sections 302/34 and 201 of the I.P.C. The prosecution story, in brief, is that on 26.5.2016 the informant's son Sikandar Uraon had gone to a relative and when he was not returned home the informant made search but to no avail. On 29.5.2016 at 7.30 A.M., the informant found that the dead body of his son was hanging in a tree. The informant made suspicion that some unknown persons killed his son. It has been submitted on behalf of the petitioners that the petitioners are in custody since 6.6.2016 and the charge sheet has been submitted in the present case. The petitioners have got no
Patna High Court Cr.Misc. No.35000 of 2016 (3) dt.20-10-2016 criminal antecedents. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are not named in the F.I.R. Except for their confessional statement before the police there is no other substantive evidence to suggest their implication in the present case. There is no eye witness to the alleged occurrence.
On behalf of the State, it is submitted that the petitioners are not named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bagaha, West Champaran in connection with Semra (Chiutaha) P.S. case No.38 of 2016.
